Trump Threatens Executive Order to End Constitutional Right to Birthright Citizenship

Birthright Citizenship

Threats by President Donald Trump to sign an executive order ending birthright citizenship have been roundly condemned by constitutional scholars and experts in the legal field. Many of those who were born in the United States, however, are worried that Trump will carry through on this threat, which comes during the lead-up to a hotly contested midterm election and is viewed by many as a cynical political ploy to earn votes during this political period.

Misstatements and Misunderstanding of the Law

Trump stated incorrectly that the United States is the only country that offers birthright citizenship to all children born inside its borders. Canada, Mexico and more than 25 other countries actually offer unconditional birthright citizenship to all children born within their borders. Birthright citizenship was established in this country by the 14th Amendment to the U.S. Constitution. It is unlikely that this constitutional guarantee could be overturned by an executive order by Trump or any other president.

Sowing Seeds of Discord

In making the statement, President Trump is playing to an audience of supporters who blame immigrants for most of the country’s woes. The latest round of rhetoric from the Trump White House has left many legal and undocumented immigrants worried about the status of their children or their own ability to live and work in the United States. For many of these individuals and families, contacting a qualified New York immigration lawyer is a good first step toward protecting their legal rights and their ability to remain in the United States.
